Terms of Sale & Conditions
By placing an order with The Next Level Inc. (“The Next Level”, “we”, “us”, or “our”), you agree to the following terms, policies, and conditions of sale. These terms apply to all purchases made through our website.
Order Acceptance
Orders are considered complete once payment has been successfully processed and the order has been confirmed by our system.
We reserve the right to cancel or refuse any order at our discretion, including but not limited to suspected fraud, pricing errors, or inventory discrepancies.
Pricing & Availability
While we strive for accuracy, errors in pricing or product information may occur. If an error is identified, we reserve the right to cancel or adjust the order and notify you accordingly.
Product availability may change without notice.
Shipping & Delivery
All orders are shipped via third-party carriers. Once an order has been transferred to the carrier, risk of loss and ownership transfers to the customer.
Delivery timelines are estimates only and are not guaranteed.
Customers are responsible for:
- Providing accurate shipping information
- Monitoring tracking updates
- Receiving deliveries
We are not responsible for:
- Carrier delays
- Lost or stolen packages after delivery
- Incorrect address submissions
International Orders
Orders shipped outside of Canada may be subject to import duties, taxes, or tariffs. These charges are the responsibility of the customer.
We are not responsible for:
- Customs delays
- Seized or rejected shipments
- Additional import fees
No refunds will be issued for items that do not comply with local import laws unless the items are returned to us in original, unused, and undamaged condition.
Free Shipping & Adjustments
Free shipping offers apply only when eligibility conditions are met.
- Selecting alternative shipping methods voids free shipping
- Orders with applied discount codes may not qualify
- Oversized or remote shipments may incur additional charges
We reserve the right to adjust shipping charges if carrier rates exceed the quoted amount.
Order Changes & Cancellations
Orders may only be modified or cancelled prior to shipment.
A 10% cancellation fee applies to all cancelled orders.
Orders that have already shipped cannot be cancelled.
Returns & Exchanges
Returns must be initiated within 15 days of purchase.
To qualify:
- Items must be unused and in original condition
- Original packaging and proof of purchase are required
A 20% restocking fee applies to eligible returns.
Shipping costs are non-refundable.
Customers are responsible for all return shipping costs and associated risks.
Refund Eligibility
Refunds are only issued once returned items are received and inspected in accordance with our return policy.
Customers who choose not to return an item are not eligible for a refund.
Retaining the product while requesting a refund is not permitted under these terms.
Final Sale Items
Any product discounted by 5% or more beyond standard Level Pricing, including sale events, promotional discounts, or clearance pricing, is considered a final sale and is not eligible for return or exchange.
The following items are also final sale:
- Used items
- Consumables (snacks, drinks, etc.)
- Broken or damaged glassware
- Clearance or “as-is” items
Damaged or Incorrect Orders
Claims must be submitted within 48 hours of delivery and must include:
- Order number
- Description of the issue
- Clear photo or video evidence
Failure to report within this timeframe may result in denial of the claim.
Refund Processing
Approved refunds are processed after inspection of returned items.
Processing time is typically 2 business days after receipt. Financial institutions may require additional time to reflect the transaction.
Shipping costs are non-refundable.
Chargebacks & Payment Disputes
By completing your purchase, you agree to follow our return, refund, and resolution procedures.
Any refunds, partial refunds, or resolutions offered and accepted by the customer are considered final and constitute full settlement of the transaction.
Once a refund or partial refund has been issued and accepted, the customer agrees not to initiate a payment dispute or chargeback for the same transaction.
Customers must return items in accordance with our return policy to be eligible for a refund. Failure to return the product while pursuing a chargeback may be treated as a fraudulent claim and may be escalated.
We reserve the right to:
- Deny future service
- Provide order details, delivery confirmation, communication history, and policy acceptance records to payment processors
- Dispute chargebacks using all available documentation
- Recover losses associated with fraudulent or unjustified chargebacks where permitted
Limitation of Liability
All products and services are provided “as is” without warranties of any kind.
We are not liable for:
- Indirect or consequential damages
- Loss resulting from misuse of products
- Third-party carrier issues

The Next Level Inc. is the legal entity operating this website and providing all products and services referenced in these terms.
Governing Law
These terms are governed by the laws of Alberta, Canada. All disputes shall be handled within the jurisdiction of Calgary, Alberta, where The Next Level Inc. operates.
